These terms of use apply to the use of the Vegemi application (“application” or “service”) by Venner Oy (“Venner”, “we” or “service provider”). These terms constitute an agreement between you and Venner Oy regarding the use of the application.

Purpose of use

The purpose of the application is to provide children, families and educators with inspiring and educational content about the positive effect of vegetables through gamification and storytelling.

Disposition

We grant you the right to use the application as an individual subject to these terms of use. The right to use the application is free of charge and valid until further notice. You can terminate it at any time by deleting the application from your mobile device. The application is designed for children older than 4 years, but the use of the application by a minor is always the responsibility of the guardian.

The user undertakes to comply with Finnish law and good practice in all use of the service in addition to these terms of use.
Please note that the product and the concept with its nutritional content and characters are free of charge only for individuals. If you want to use the product as part of your own service, event, offering or training content, please request a quote from our license model.

Intellectual property rights

The content produced by the user is not used for anything other than the provision and development of the service. The application’s image recognition feature is built using the image bank recognition provided by the Clarifai application. Clarifai’s terms of use can be found here.

The application, its contents and appearance are protected by the Finnish Copyright Act and all other applicable legislation. All rights, such as ownership, copyright and other intellectual property rights to the application and to the material included or related to it, are the property of Venner Oy or our licensors. We reserve all rights not expressly granted in these Terms of Use.

Your responsibility

The user is responsible for the acquisition, costs and functionality of the equipment, software and communication and telecommunications connections required to use the application. The user is fully responsible for the damage caused to Venner Oy, other users and third parties by the use of the application contrary to the terms of use, any other contractual terms and conditions and the law or good practice.

Limitations of liability

Despite our best efforts, we cannot guarantee that the application will always be available to you without interruption. There may be interruptions in the application, or the prevention of use, or errors or deficiencies in its content due to e.g. maintenance actions, technical problems, third-party data transfer problems or other similar reasons.
The right to use the application is granted to you on an “as is” basis. We do not guarantee that the application would meet your requirements or work in all operating environments.
We will not be liable to you or any third party for any errors, delays or damages arising from the use of the application. We are not responsible for any lawsuits, claims or actions brought against you by third parties, or for damages caused by the application.

Please make sure that the food items you serve are suitable for you/the user, and you serve them according to the age level, taking safety into account. The application does not take a position on the serving of vegetables and cannot take the user’s age into account.

Disclaimer

We do not provide any health, dietary or nutritional advice, nor do we endorse any specific diets. Our services should not be used for such purposes. Our purpose is to provide inspiration for fresh fruit and veggies consumption, and to make this fun for children, families and educators. Vegemi inspires children to taste fruits and vegetables, responsible adults concerned with food allergies or intolerances of their child need to be aware of this risk. Vegemi/Venner will not assume any liability for adverse reactions to food consumed connected with Vegemi. Responsible adults are also advised to prepare the fruits and vegetables into appropriate bite-size pieces for their child to reduce choking risk, as Venner/Vegemi will not assume any liability for choking, or similar.

Changes

Venner has the right to change these terms of use in such a way that they correspond to the nature of the service, functionalities or changes in these. The applicable terms of use can be found in the application. When you continue to use the application after the terms of use have been changed, you agree to comply with the new terms. We always inform you about significant changes to the terms of use separately in the application.

Applicable law

Finnish law applies to the terms of use.
